MINUTES OF MEETING
June 17, 2004
Urbandale, Iowa
The June 17, 2004 meeting of
the State Board of Education was held at the Murray Conference Center, Living
History Farms in Urbandale. The
following Board members were present:
Gene Vincent, Sally Frudden, Jim Billings, Charles Edwards, Sister Jude
Fitzpatrick, Rosie Hussey, Greg McClain, Mary Jean Montgomery and Wayne
Kobberdahl. Megan Srinivas –
Absent. Also present were Department
director Ted Stilwill and Department staff members Gail Sullivan, Carol Greta,
Judy Jeffrey, Lee Tack, Jeff Berger, Janice Friedel, Kathi Slaughter and
Beverlee Adams. Also present was
Madelaine Jerousek, Des Moines Register.
President Gene Vincent
called the meeting to order at 8:45 a.m.
It was moved by Sister Jude
Fitzpatrick and seconded by Sally Frudden to approve the agenda as written.
Carol Greta, legal
consultant presented an overview of Chapter 17, Open Enrollment, rule
amendments. She indicated that Iowa
Code section 256.7 provided authority for the State Board of Education to
promulgate rules from Department of Education guidelines and decisions and to
implement statutory language. The
amendments implement 2003 Acts, Chapter 180, section 35, as passed by the 80th
General Assembly as well as to implement guidelines and past precedent set in
State Board of Education decisions.
Vote: It was moved by Mary Jean Montgomery and
seconded by Sister Jude Fitzpatrick to approve adoption of the amendments to
Chapter 17, “Open Enrollment.”
Motion: The motion carried unanimously.
Legal
Consultant, Carol Greta reviewed Chapter 33, “Educating the Homeless,” rule
amendments. Iowa Code section 256.7
provided authority for the State Board of Education to promulgate rules to implement
statutory language. The proposed
amendments implement the provisions of the McKinney-Vento Homeless Assistance
Act, 42 U.S.C. sections 11431, et seq., which is part of the Federal “No Child
Left Behind Act.”
Vote: It was moved by Mary Jean Montgomery and
seconded by Rosie Hussey to approve the adoption of the amendments to Chapter
33, “Educating the Homeless.”
Motion: The motion carried unanimously.
President Gene Vincent adjourned the business meeting at 9:00 a.m.
